1. Introduction

Welcome to Rushikesh Mokashi (“Company”, “we”, “our”, or “us”). These Terms & Conditions (“Terms”) govern your access to and use of our website, applications, platforms, communication services, and related offerings (collectively, the “Services”), including services enabled through WhatsApp Official Business API, RCS (Rich Communication Services), and other messaging or digital communication channels.

If you do not agree with any part of these Terms, you must discontinue use of the Services immediately.

  • “WhatsApp API” refers to Meta’s Official WhatsApp Business API.
  • “RCS” refers to Rich Communication Services enabled through telecom partners.
  • “Content” includes text, messages, media, templates, data, or materials transmitted through our Services.
  • “Applicable Law” refers to laws in force in India, including IT Act, 2000 and its amendments.

3. Acceptance of Terms

By registering, accessing, browsing, or using the Services of Rushikesh Mokashi, you acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, and any additional guidelines or policies incorporated by reference.

Electronic acceptance constitutes a valid legal agreement under the Information Technology Act, 2000.

4. Description of Services

Rushikesh Mokashi provides digital communication, messaging enablement, business messaging integration, customer outreach, notification delivery, and related technology services. Our Services may include:

  • WhatsApp Official Business API enablement
  • RCS messaging solutions
  • Business communication setup and management
  • Message templates, campaign tools, and analytics
  • Customer engagement and transactional messaging

We act as a technology facilitator and do not originate message content unless explicitly agreed in writing.

5. Eligibility

To use our Services, you must:

  • Be at least 18 years of age
  • Have the legal authority to enter into binding contracts
  • Represent a lawful business or individual activity
  • Comply with Indian laws and Meta/RCS platform policies

Use by minors is strictly prohibited.

6. Account Registration

Certain Services require account registration. You agree to:

  • Maintain confidentiality of login credentials
  • Notify us immediately of unauthorized access

Rushikesh Mokashi is not responsible for losses arising from unauthorized account usage.

7. User Responsibilities

  • Violating Meta WhatsApp Business Policy or RCS rules
  • Sending messages without proper end-user consent

8. Payment & Billing Terms

Paid services are subject to pricing agreed upon at the time of subscription or contract.

  • All fees are exclusive of applicable taxes (GST)
  • Payments are non-refundable unless stated otherwise
  • Failure to pay may result in service suspension

Rushikesh Mokashi reserves the right to revise pricing with prior notice.

9. Subscription Renewal & Termination

Subscriptions may auto-renew unless cancelled in advance. We reserve the right to:

  • Suspend or terminate Services for policy violations
  • Terminate inactive or non-compliant accounts
  • Retain data as per legal obligations

Termination does not waive outstanding payment obligations.

10. Use of WhatsApp Official API & RCS

Use of WhatsApp and RCS services is governed by:

  • Meta WhatsApp Business Policies
  • Telecom operator RCS policies
  • Applicable Indian telecom regulations

We are not responsible for platform-level restrictions, template rejections, or number bans imposed by Meta or telecom operators.

11. Message Delivery & Compliance Policy

Message delivery depends on multiple external factors, including:

  • Network availability
  • Platform approval
  • Recipient device compatibility

Rushikesh Mokashi does not guarantee delivery, read receipts, or response rates.

12. Intellectual Property Rights

All intellectual property, including software, trademarks, designs, and content, belongs to Rushikesh Mokashi or its licensors.

Users are granted a limited, non-exclusive, revocable license to use the Services strictly as permitted.

13. Confidentiality

Both parties agree to maintain confidentiality of proprietary, technical, commercial, and customer information unless required by law.

14. Disclaimer of Warranties

Services are provided “as is” and “as available.”
We disclaim all warranties, including:

  • Merchantability
  • Fitness for a particular purpose
  • Error-free or uninterrupted service

15. Limitation of Liability

To the maximum extent permitted by law, Rushikesh Mokashi shall not be liable for indirect, incidental, special, or consequential damages.

Total liability shall not exceed the amount paid by the User in the preceding three (3) months.

16. Indemnification

You agree to indemnify and hold harmless Rushikesh Mokashi against claims arising from:

  • Your misuse of Services
  • Violation of laws or policies
  • Unauthorized message content

17. Governing Law (India)

These Terms are governed by the laws of India. Courts located in Pune, Maharashtra, shall have exclusive jurisdiction.

18. Changes to Terms

We may update these Terms periodically. Continued use after updates constitutes acceptance.
